1. The Haunts Service
Haunts is a United States nightlife, venue, Event, performer, and local-discovery service.
Haunts may provide information about:
- bars;
- restaurants;
- coffee shops;
- clubs;
- pop-ups;
- Events;
- performers;
- Crawls;
- Collections;
- venue amenities;
- nightlife activities; and
- other local businesses or experiences.
Some information is provided by Haunts, some by businesses or performers, some by users, and some from publicly available or other permitted sources.
Haunts does not guarantee that every listing, Event, schedule, price, admission rule, business detail, or other piece of information is current or error-free.
2. Eligibility
You must be at least 18 years old to create or maintain a Haunts account.
By creating an account, you represent that you are at least 18 years old and legally capable of agreeing to these Terms.
Haunts does not collect your date of birth merely to enforce this account rule.
Some venues and Events have additional requirements, including 21+ admission requirements.
A Haunts account does not establish:
- your age for venue-entry purposes;
- your identity;
- your legal eligibility to consume alcohol;
- your legal eligibility to enter an establishment; or
- your right to attend a particular Event.
You are responsible for complying with applicable law and the rules of each venue or Event you visit.
3. United States Service
Haunts is offered for use in the United States.
These Terms are written for the United States service operated by Saronis Applications LLC.
4. Your Account
You are responsible for activity performed through your account and for keeping your credentials secure.
Do not:
- share your password with someone who should not have access to your account;
- use another person’s account without permission;
- impersonate another person or organization;
- create an account for fraudulent purposes; or
- attempt to bypass account restrictions.
You must provide information that is accurate where accuracy is necessary for the feature you are using.
Your public username or handle does not need to be your legal name unless a particular verification feature expressly requires identity-related information.
5. Email Accounts
You may create a Haunts account using an email address and password.
If you do, you are responsible for maintaining access to the email account used for authentication and recovery.
Haunts may send account, transactional, security, operational, and promotional communications as described in the Privacy Policy and your communication preferences.
6. Accounts Without Email
Haunts allows you to create an account without providing a personal email address.
An email-less account uses a username and password.
If you create an account without a verified recovery email and lose your password or otherwise lose access to the account, Haunts cannot recover the account for you.
Haunts does not provide security-question recovery or manual support overrides for an unrecoverable email-less account.
You may later add and verify a recovery email. Once you do, supported recovery functionality may become available.
You are responsible for considering this risk before choosing email-less registration.
7. Adult-Oriented Venue Listings
Haunts may list adult-oriented businesses, including strip clubs and other establishments intended for adults.
These are factual business listings.
Haunts is not an adult-content or pornography service.
An adult-oriented venue listing may include ordinary business information such as:
- name;
- location;
- hours;
- age requirements;
- business description;
- amenities;
- Events; and
- ordinary non-explicit photographs.
Haunts does not guarantee that you are legally eligible to enter an adult-oriented or age-restricted establishment.
8. Sexually Explicit Content Is Not Permitted
You may not use Haunts to upload, publish, or distribute pornography or sexually explicit material.
This includes sexually explicit:
- photographs;
- video;
- illustrations;
- profile material;
- Event material; or
- other user-generated content.
A factual listing for an adult-oriented establishment is not, by itself, prohibited content.
Ordinary non-explicit business imagery and factual venue information remain permitted.
9. Location Features
Haunts may use location information to provide:
- local discovery;
- maps;
- distance ordering;
- venue proximity information; and
- check-in verification.
You control whether to invoke device-location features.
A venue check-in or location verification does not guarantee that you actually purchased anything, entered a venue, complied with venue rules, or had a particular experience.
Attempting to spoof, manipulate, fabricate, automate, or otherwise falsify location verification may result in removal of associated ratings, scores, benefits, or account access.
10. Ratings
Haunts may require an eligible venue check-in before an account can rate a venue.
Your rating must represent your own use of the applicable Haunts feature.
Do not:
- create fake ratings;
- use multiple accounts to manipulate a rating;
- accept compensation in exchange for deceptive ratings;
- coordinate artificial rating campaigns; or
- manipulate check-in eligibility to obtain rating access.
Haunts may remove ratings that violate these Terms or are associated with manipulated eligibility.
11. User-Generated Content
“User Content” means content you submit to Haunts, including:
- profile material;
- photos;
- ratings;
- Collections;
- Crawls;
- Events;
- venue nominations;
- venue or performer corrections;
- descriptions;
- claim material; and
- other submissions.
You retain ownership of User Content that you own.
By submitting User Content, you grant Saronis Applications LLC a nonexclusive, worldwide, royalty-free license to host, store, reproduce, format, resize, display, transmit, and otherwise use that User Content as reasonably necessary to:
- operate Haunts;
- display the content through the features you selected;
- moderate the content;
- technically process the content; and
- provide the service.
This license does not transfer ownership of your User Content to Haunts.
The license ends when your User Content is deleted, except to the limited extent a temporary technical backup copy has not yet expired through normal infrastructure rotation.
If you permanently delete your account, User Content associated with that account is deleted as described in the Privacy Policy.
12. Rights to Content You Submit
You may submit content only if:
- you own it;
- you have permission to submit it; or
- you otherwise have the legal right to provide it to Haunts.
Do not submit material that unlawfully infringes another person’s:
- copyright;
- trademark;
- privacy;
- publicity rights;
- confidential information; or
- other legal rights.
Haunts may remove content when there is a reasonable basis to believe it violates these Terms or applicable law.
A formal DMCA/designated-agent procedure is not established by these Terms.
Copyright-specific procedures may be added separately in the future.
13. Business and Performer Information
If you claim or manage a venue or performer profile, you represent that the information you provide in connection with that claim is truthful and that you are authorized to seek the requested access.
Do not:
- falsely claim a venue;
- falsely claim a performer;
- impersonate an owner, employee, representative, or performer;
- submit fabricated evidence; or
- use management access to misrepresent a business or performer.
Haunts may:
- require evidence;
- approve or deny access;
- revoke management access;
- correct factual information;
- investigate conflicting claims; and
- remove unauthorized changes.
Management access to a profile does not transfer ownership of Haunts’ underlying database, taxonomy, software, or platform presentation.
14. Events
Events may be submitted or maintained by:
- venues;
- performers;
- administrators; or
- other authorized sources.
Haunts may display information about who published an Event or whether a venue has confirmed it.
You are responsible for verifying important Event details directly with the venue, organizer, performer, or ticket provider before relying on them.
Events may:
- change;
- be canceled;
- sell out;
- change age restrictions;
- change performers;
- change times; or
- contain inaccurate information.
Haunts is not responsible for a venue’s or organizer’s decision to change or cancel an Event.
15. Crawls and Collections
Crawls and Collections may be created by Haunts, users, or authorized contributors.
A Crawl or Collection is informational and does not guarantee:
- venue admission;
- venue availability;
- transportation;
- safety;
- operating hours;
- Event admission;
- accessibility; or
- suitability for a particular person.
Use your own judgment when visiting locations.
16. Venue and Business Information
Haunts attempts to provide useful venue information, but business information changes frequently.
Haunts does not guarantee the accuracy of:
- operating hours;
- menus;
- amenities;
- prices;
- admission restrictions;
- contact information;
- accessibility information;
- Event information; or
- venue status.
If information is important to your plans, verify it with the relevant business.
17. Alcohol, Nightlife, and Personal Responsibility
Haunts provides discovery information. It does not sell alcohol and does not control how a venue serves alcohol.
You are responsible for:
- complying with applicable drinking-age laws;
- drinking responsibly;
- arranging safe transportation;
- complying with venue rules;
- making personal safety decisions; and
- complying with applicable law.
Never drive while impaired.
Haunts does not guarantee the safety of any venue, neighborhood, Event, Crawl, performer, business, patron, transportation provider, or other third party.
18. Prohibited Conduct
You may not use Haunts to:
- violate applicable law;
- threaten, harass, stalk, or abuse another person;
- promote or facilitate violence;
- commit fraud;
- impersonate another person or organization;
- manipulate check-ins, ratings, scores, or leaderboards;
- submit knowingly false claims;
- distribute malware;
- attempt unauthorized access to accounts or systems;
- interfere with service operation;
- evade suspensions or restrictions;
- scrape or automate access in a manner that materially interferes with Haunts or circumvents technical controls;
- upload pornography or sexually explicit content;
- upload illegal material;
- violate another person’s intellectual-property rights;
- expose another person’s private information without authorization;
- spam users or services;
- exploit Haunts for deceptive commercial activity; or
- encourage others to violate these Terms.
Haunts may investigate and act on suspected violations.
19. Moderation
Haunts may:
- remove content;
- reject submissions;
- correct records;
- restrict features;
- suspend accounts;
- revoke management permissions; or
- terminate accounts
when reasonably necessary to enforce these Terms, protect users or the service, comply with law, or address abuse.
Haunts is not required to pre-screen every item of User Content.
Failure to act on one violation does not waive the right to act on the same or another violation later.
20. Promotional Communications
If you provide an email address, promotional communications are enabled by default.
You may opt out through Account Settings and through applicable unsubscribe mechanisms in promotional messages.
Opting out of promotional communications does not prevent Haunts from sending necessary:
- authentication;
- account-security;
- password-recovery;
- transactional;
- operational; or
- legal communications.
21. Third-Party Services
Haunts may provide links or integrations involving third parties, including:
- venue websites;
- ticket sellers;
- social networks;
- transportation services;
- map providers; and
- other external services.
Haunts does not control those third parties.
Your dealings with third parties are between you and the third party unless Haunts expressly states otherwise.
Their terms and privacy policies apply to their services.
22. No Paid Haunts Services at This Time
Haunts does not currently offer paid Haunts subscriptions or accept payments through the Haunts application.
These Terms therefore do not establish subscription billing, recurring-payment, refund, or payment-card terms.
If Haunts introduces paid services, applicable terms will be added before those services become available.
23. Permanent Account Deletion
You may permanently delete your Haunts account.
Deletion means deletion.
Account deletion removes the account and associated user-provided and user-generated information as described in the Privacy Policy.
Haunts does not merely deactivate your account and retain it indefinitely for advertising or profiling.
Deleting your contribution does not require Haunts to delete independently sourced factual information about a public business, venue, Event, or performer solely because the same fact was previously supplied through your account.
Account deletion is permanent.
Once an email-less account is deleted or becomes unrecoverable before a recovery email is established, Haunts cannot restore it.
24. Haunts Intellectual Property
Except for User Content and third-party material, the Haunts service and its associated:
- software;
- design;
- branding;
- logos;
- graphics;
- taxonomy presentation;
- database organization;
- interfaces; and
- original content
are owned by Saronis Applications LLC or used under applicable license.
These Terms do not grant you ownership of Haunts intellectual property.
You may use Haunts only as permitted through the service and these Terms.
25. Feedback
If you voluntarily provide ideas, suggestions, or feedback about Haunts, Saronis Applications LLC may use that feedback without obligation to compensate you.
This does not transfer ownership of unrelated User Content.
26. Account Suspension and Termination
Haunts may suspend or terminate access if you materially violate these Terms, create security or legal risk, engage in fraud or abuse, or misuse the service.
Where appropriate, Haunts may instead restrict a particular feature or remove specific content.
You may end your relationship with Haunts at any time by permanently deleting your account.
27. Changes to the Service
Haunts will evolve.
Features may be:
- added;
- changed;
- restricted;
- discontinued; or
- replaced.
Haunts does not guarantee that a particular free feature will remain available forever.
If a change materially affects the legal terms governing your account, Haunts may update these Terms and provide appropriate notice.
28. Disclaimer of Warranties
To the fullest extent permitted by applicable law, Haunts is provided “as is” and “as available.”
Saronis Applications LLC does not warrant that:
- the service will always be available;
- information will always be accurate;
- every venue or Event will be safe;
- every listing will be current;
- every third-party service will function;
- the service will be error-free; or
- every defect will be corrected immediately.
Nothing in Haunts should be treated as a guarantee of venue admission, personal safety, legal compliance by a venue, Event availability, transportation availability, or fitness for a particular purpose.
Some jurisdictions may not permit particular warranty exclusions, so portions of this section may not apply to you.
29. Limitation of Liability
To the fullest extent permitted by applicable law, Saronis Applications LLC and its officers, employees, contractors, and agents will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages arising from or related to your use of Haunts.
This includes, where legally permitted, losses arising from:
- reliance on inaccurate venue or Event information;
- third-party conduct;
- venue admission decisions;
- transportation;
- account loss caused by choosing an email-less account without recovery;
- lost data;
- service interruption; or
- unauthorized third-party activity outside Haunts’ reasonable control.
To the fullest extent permitted by applicable law, the aggregate liability of Saronis Applications LLC for claims arising out of or relating to Haunts will not exceed $100.
This limitation does not apply where applicable law prohibits the limitation.
30. Indemnification
To the extent permitted by applicable law, you agree to defend, indemnify, and hold harmless Saronis Applications LLC and its officers, employees, contractors, and agents from claims, damages, liabilities, losses, and reasonable expenses arising from:
- User Content you submit;
- your violation of these Terms;
- your violation of another person’s rights;
- fraudulent venue or performer claims;
- unlawful use of Haunts; or
- your intentional misuse of the service.
This obligation does not require you to indemnify Saronis Applications LLC for its own unlawful conduct where such indemnification is prohibited by law.
31. Governing Law and Venue
These Terms are governed by the laws of the State of Georgia, without regard to conflict-of-law principles that would require application of another jurisdiction’s laws.
Any judicial proceeding arising from these Terms or your use of Haunts must be brought in a state or federal court with appropriate jurisdiction in Georgia, unless applicable law requires otherwise.
These Terms do not require arbitration.
32. Severability
If a provision of these Terms is found unenforceable, the remaining provisions remain in effect to the fullest extent permitted by law.
An unenforceable provision should be interpreted as closely as legally possible to its intended purpose rather than invalidating the Terms as a whole.
33. No Waiver
If Haunts does not immediately enforce a provision of these Terms, that does not waive the right to enforce it later.
34. Entire Agreement
These Terms, together with the Privacy Policy and other policies expressly incorporated into them, constitute the agreement governing your use of Haunts.
35. Changes to These Terms
Haunts may update these Terms.
Material changes may be communicated through Haunts or by other appropriate means.
Where Haunts determines that renewed agreement is appropriate, continued account use may require you to affirmatively accept the updated Terms.
The version identified by the effective date and last-updated date is the current version.
